Terms of Service for My Cat Panion

These Terms of Service ("Terms") are a legal agreement between you and Zaceos, a sole proprietorship owned by Zac Reichert, based in Washington State, USA ("we," "us," or "our"), governing your use of the My Cat Panion mobile application for iOS and Android ("the app"). Please read them carefully.

1. Acceptance of these Terms

By downloading, creating an account on, or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app. If you are using the app on behalf of someone else, you confirm you are authorized to accept these Terms for them. You must be at least 13 years old to use the app.

2. Description of the service

My Cat Panion is a consumer cat-care education and tracking app. It provides educational lessons and courses about cat care, a Wellbeing section where you can record information about your cat (such as weights, medications, vitals, nutrition, grooming, vet visits, vaccinations, behavior, and related notes), daily trivia, and AI-assisted features that offer general guidance and help explain cat behavior, body language, and vocalizations. The app is an educational and record-keeping tool. It does not provide veterinary, medical, or other professional advice. See Section 7 and our separate Disclaimer.

3. Your account and responsibilities

To use most features, you create an account with an email address and password. You are responsible for keeping your login credentials confidential and for all activity under your account. You agree to provide accurate information and to keep it current. Notify us promptly at zac.r22@gmail.com if you suspect unauthorized use of your account. You are responsible for the accuracy of the information you enter about your cat; the app stores what you provide and does not verify it.

4. Subscriptions, free trial, and billing

The app offers a single paid subscription tier at $10 per month or $100 per year, with a one-week free trial for new subscribers. Subscriptions unlock the app's paid features.

Billing is handled by Apple In-App Purchase or Google Play Billing, depending on your platform, and is managed through RevenueCat. We do not receive or store your payment card information. The following terms apply to subscriptions purchased through Apple. Equivalent terms apply through Google Play, subject to Google's billing rules.

To cancel, use the subscription management settings in your App Store or Google Play account before the next renewal date. Canceling stops future renewals; it does not retroactively refund the current period. Refunds, where available, are handled by Apple or Google under their policies, not by us. Prices may change; we will provide notice of price changes as required by the applicable app store and law, and any change applies to future billing periods.

Canceling your subscription is separate from deleting your account. To delete your account and data, use Settings, then Delete Account, as described in our Privacy Policy.

6. Intellectual property

The app, including its software, design, text, educational content, course materials, and trivia, and all related intellectual property, is owned by Zaceos or its licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your own personal, non-commercial cat-care purposes, subject to these Terms. You may not copy, distribute, publicly display, resell, or create derivative works from our content without our written permission.

You retain ownership of the information you enter about your cat. By entering it, you grant us the limited rights needed to store, process, sync, and display it to you, and to operate the features you use, as described in our Privacy Policy.

7. Educational content, not professional advice

The app provides general educational information and record-keeping tools. It does not provide veterinary, medical, or other professional advice, and it is not a substitute for the judgment of a licensed veterinarian. AI-assisted features generate general information that can be incomplete or wrong. The tracking tools are for your own records and are not a medical device. Always consult a licensed veterinarian for your cat's health, and seek emergency veterinary care for urgent situations. This section is summarized here and stated in full in our separate Disclaimer, which is incorporated into these Terms by reference.

8. Disclaimer of warranties

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that any information it provides, including AI output, is accurate, complete, or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

9. Limitation of liability

To the maximum extent permitted by law, Zaceos and Zac Reichert will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of, or inability to use, the app, including any reliance on educational content or AI output, or any harm to or decision regarding your cat. To the maximum extent permitted by law, our total liability for any claim arising from or related to the app will not exceed the greater of the amount you paid us for the app in the twelve months before the claim, or twenty-five US dollars. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

10. Governing law

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your place of residence apply.

11. Dispute resolution

If you have a concern, please contact us first at zac.r22@gmail.com so we can try to resolve it informally. If we cannot resolve a dispute informally, you agree that the state and federal courts located in Washington State will have jurisdiction, except where the laws of your place of residence give you the right to bring a claim elsewhere. Nothing in these Terms limits any non-waivable statutory rights you have as a consumer.

12. Termination

You may stop using the app at any time and may delete your account from within the app. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the app. On termination, your right to use the app ends. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and governing law, will survive.

13. Apple and Google app store terms

Your use of the app obtained through the App Store or Google Play is also subject to that store's terms. Where Apple's standard End User License Agreement applies, you acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the app or its support; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Similar acknowledgments apply to Google where its terms govern.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide notice in the app. Your continued use of the app after an update means you accept the revised Terms.
